
Vashu Bhagnani of Puja Entertainment has welcomed the interim protection granted by the court in the ongoing intellectual property dispute against Tips Music. The legal battle centers around the alleged unauthorized use of Bollywood intellectual property rights for several prominent films and their music.
The Scope of the 'Status Quo' Order
The court's "status quo" order, according to Bhagnani's legal team, comprehensively covers all films, songs, and music rights mentioned in the suit. This significant ruling impacts a wide array of popular cinematic works:
• `Coolie No. 1`
• `Hero No. 1`
• `Biwi No. 1`
• `Bade Miyan Chote Miyan`
• `Tera Jadoo Chal Gayaa`
• `Mujhe Kucch Kehna Hai`
It also concerns the proposed release of `Hai Jawani Toh Ishq Hona Hai` starring Varun Dhawan.
A Landmark Ruling for Producers Bhagnani's legal team emphasized that this interim relief marks a crucial victory for film producers across the industry. "Certainly, this is a victory for all producers, and they must come together to assert and protect their rights," the statement read. The producer believes that the order underscores the importance of safeguarding intellectual property in Bollywood.
Furthermore, the lawyer highlighted that all individuals associated with the mentioned projects, including actors, director David Dhawan, and other technicians, might be required to appear before the court and submit their replies to avoid potential contempt of court proceedings.
Combating Unauthorized Recreation and Digital Exploitation A key concern raised by Bhagnani is the unauthorized monetization of recreated and remixed songs from his films. He stated, "If someone misuses it without my consent, my rights are directly affected, and it also causes me substantial financial loss." Bhagnani clarified that neither he nor his company was approached or informed about any such recreation.
The dispute also sheds light on the evolving landscape of digital rights. Bhagnani argues that in earlier years, producers only granted music rights, not the extensive rights now associated with video streaming, social media, or OTT platforms, from which music companies are currently generating substantial revenues.
